These terms govern your use of the talkwithbenjamin.uk website. They do not cover the terms of any therapy service you receive — those are set out in a separate agreement you sign digitally through the client portal before therapy begins. The exception is the complaints section below, which applies to the therapy service as well as to this website, so that it is available to you whether or not you are currently a client.

Acceptance of Terms

By accessing or using this website, you agree to be bound by these terms. If you do not agree, please do not use the website.

Use of the Website

You may use this website for lawful purposes only. You agree not to:

  • Use the website in any way that breaches applicable law or regulation
  • Attempt to gain unauthorised access to the client portal, our systems, or any account other than your own
  • Interfere with or disrupt the operation of the website or its underlying infrastructure
  • Copy, reproduce, or republish website content without permission, except as permitted below

Intellectual Property

All content on this website, including text, graphics, logos, and images, is owned by Benjamin Mitchell or used under licence, unless otherwise stated. You may view and print pages for personal, non-commercial use. Any other reproduction or redistribution requires prior written permission.

No Professional Advice

Content on this website, including blog articles, is provided for general informational purposes only. It does not constitute therapeutic, medical, or professional advice, and does not create a therapist-client relationship. If you are experiencing a mental health crisis, please see our urgent support page for emergency resources.

The Client Portal

Access to the client portal requires an account and is protected by Magic Link authentication as described in our privacy policy. Any therapy services, fees, cancellation terms, and confidentiality provisions are governed by the separate digital agreement you sign within the portal, not by these website terms.

This website may contain links to third-party websites. We are not responsible for the content, accuracy, or practices of any linked external sites.

Disclaimer and Limitation of Liability

This website and its content are provided “as is” without warranties of any kind, to the extent permitted by law. We do not guarantee that the website will be uninterrupted, error-free, or secure at all times.

To the fullest extent permitted by law, Benjamin Mitchell shall not be liable for any indirect, incidental, or consequential loss arising from your use of, or inability to use, this website. Nothing in these terms limits liability for death or personal injury caused by negligence, or for any other liability that cannot be excluded under UK law.

Professional Standards and Concerns

I am an Accredited Registrant of the National Counselling and Psychotherapy Society (NCPS), membership number NCS23-03006, and I practise in accordance with the NCPS Code of Ethical Practice.

If you are unhappy with any aspect of the service you have received — whether that concerns this website or the therapy itself — please raise it with me directly in the first instance, by email at benjamin@talkwithbenjamin.uk. I aim to acknowledge complaints within 2 business days. Most concerns are best resolved in a straightforward conversation, and raising something early usually makes that easier.

If you would rather not raise the matter with me, or you have done so and remain dissatisfied, you can take your complaint to my professional body. The NCPS operates an independent complaints procedure:

You are entitled to complain to the NCPS whether or not you have raised the matter with me first, and you may do so after therapy has ended.

Complaints about how your personal data has been handled are covered separately in our privacy policy, which also sets out your right to complain to the Information Commissioner’s Office.

Changes to These Terms

We may update these terms from time to time to reflect changes in our practices or legal requirements. The “last updated” date shows when changes were made. Continued use of the website after changes are posted constitutes acceptance of the revised terms.

Governing Law

These terms are governed by the laws of England and Wales. Any disputes arising from your use of this website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
